This is a Ten Day Notice For Nonpayment of Rent. The City of Evanston Residential Landlord Tenant Ordinance changes what is typically a five day notice (for unpaid rent) into a ten day notice!  This should not be confused with a ten day notice for breach of a lease provision!  The notice below is a sample of a landlord’s ten day notice that is commonly used when a tenant fails to pay the rent in the City of Evanston. While the ten day time period may not be shortened by agreement of the parties in a lease, the time period may be longer than ten days if the lease provides for a longer notice period.  The requirements for the contents and service of a ten day notice or any other eviction notice are highly technical. YOU ARE FURTHER NOTIFIED that full payment of said sum so due has been and is demanded of you, and that UNLESS FULL PAYMENT THEREOF IS MADE ON OR BEFORE THE EXPIRATION OF TEN DAYS AFTER THE SERVICE OF THIS NOTICE, your tenancy of said premises shall be terminated ten legal days after the date of service of this notice, excluding legal holidays.  Should the tenth day of the ten day period be a Saturday, Sunday, or holiday, the tenth day shall become the next business day.

ONLY FULL PAYMENT of the rent demanded in this notice will waive the Landlord’s right to terminate the lease under this Notice, unless the Landlord agrees in writing to continue the lease in exchange for receiving partial payment.
