Governor Quinn signs new eviction legislation SB 1766

On August 2, 2011, Governor Quinn signed into law Senate Bill 1766 which became Public Act 97-0236, a bill opposed by the Chicago Creative Investors Association and the Illinois Rental Property Owners Association.  The law which amends Section 9-120 of the Code of Civil Procedure (the eviction law that deals with a leased premises used in furtherance of a criminal offense), as enacted, purports to provide additional rights to landlords related to crime on a rental premises.  The CCIA makes a number of arguments against the law.

Landlords and Tenants and Flooding

Here’s a common scenario: during a storm, rainwater seeps up through the floor of a garden apartment, crests at two inches and eventually subsides.  Flooding seems to be a hot topic in northern Illinois this week.  Even our firm has been “evicted” from our usual place of business in Chicago and we are running a “virtual office” thanks to this past weekend’s floods.  What is a tenant to do when there is a flood and what are the landlord’s obligations in a flood situation?

Figuring out what Sheriff’s district you are in for a Cook County Eviction

In a past blog post, I brought my readers through a copy of a typical Cook County Sheriff eviction information letter.  That’s the letter the Sheriff sends to a landlord or landlord’s attorney that contains the Sheriff’s District and Receipt Number.  Lately, my office has not been receiving these notices in the mail.  Recently, we found out on the morning of an eviction that it was proceeding that day.  As such, it is necessary to come up with a way to possibly figure out the district number without the assistance of the letter that may or may not timely arrive in the mail.

Cook County Sheriff changes eviction procedure

NOTE: The form below is NOT the current form.  Please see here.  Landlords placing an eviction with the Cook County Sheriff have a new form to fill out when they place their eviction for execution by the Sheriff.  The form is informational in nature and must be presented to the Sheriff’s office at the same time the eviction fee is paid and the order is placed.  In my opinion, this form (which can be found after the jump) is much improved from previous versions.
