Deep dive into the Federal Eviction Moratorium
As readers of this blog are aware, the Federal government has gotten into the landlord-tenant business. This past Tuesday, the Centers for Disease Control and Prevention issued an unpublished order that is expected to be published in the Federal Register on September 4, 2020 purporting to put a moratorium on certain residential evictions until December 31, 2020. As discussed here last week, over the weekend, by way of Executive Order 2020-52, Governor Pritzker has extend the moratorium on commencement and execution of certain evictions until September 19, 2020. I will not bother to opine on how this policy decision will negatively impact landlords nor the hopeless unfairness of this policy to small and large housing providers. Massive Delays in Cook County Eviction Courts
Are you a landlord with a case pending in the Cook County Circuit Court system? As noted on this blog, in late July, Judge Kenneth Wright entered an order postponing ALL eviction court dates pending for August appearances. The County has developed a system to increase the caseload of the eviction judges by 10 cases per judge per day four days a week. The results of that rescheduling are now being made known and the results are shocking.
Cook County Residential Tenant and Landlord Ordinance Would Apply in Most of Suburban Cook County
On July 30, 2020, I reported here that Cook County was proposing a County-wide tenant and landlord ordinance.
